1. Acceptance of these Terms

These Terms of Service (the "Terms") form a binding agreement between you and MyHobby ("MyHobby", "we", "us") governing your access to and use of the MyHobby website, applications, and services (collectively, the "Service").

By creating an account, checking the acceptance box at sign-up, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your province, state, or country of residence, to create an account and use the Service. The Service is not directed to children, and we do not knowingly collect information from anyone under the age of majority.

By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You agree to provide accurate account information and to keep it current. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a security or legal risk.

4. Your content and the licence you grant

You retain ownership of the photos, descriptions, and other content you submit to the Service ("Your Content"). You are solely responsible for Your Content and represent that you have the rights necessary to submit it.

By submitting Your Content, you grant MyHobby a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (e.g., resize/crop images), publish, and display Your Content for the purpose of operating, promoting, and improving the Service. This licence ends when you delete Your Content or your account, except for content others have shared or that we must retain to comply with law.

You grant other users the right to view Your Content that you choose to make public (for example, public collection items and profile information).

5. Acceptable use

You agree not to: (a) post unlawful, infringing, fraudulent, hateful, or sexually exploitative content; (b) impersonate others or misrepresent your affiliation; (c) upload content depicting or sexualizing minors; (d) attempt to gain unauthorized access to the Service or other accounts; (e) scrape, overload, or interfere with the Service; (f) use the Service to send spam or unlawful communications; or (g) list items whose sale or transfer is prohibited by law.

No nudity or adult content. You may not upload, list, trade, or display any image containing nudity, sexual content, or other adult material. This is a strict, zero-tolerance rule and applies to all photos, including item, profile, and cover images.

No alcohol. Alcohol and alcoholic beverages — including beer, wine, and spirits, whether sealed, branded, or collectible — may not be offered for sale, offered for trade, or catalogued for display on the Service.

Automated and manual review. We use automated tools (including AI image analysis) and human moderators to detect content that may breach these rules. Content that is flagged is sent for review and is hidden from public view in the meantime. While an item is flagged it is visible only to you, marked "Sent for approval", and cannot be deleted by you — only a moderator can change its status. A moderator may approve it (restoring public visibility), decline it (it stays hidden and locked), or keep it pending. We may remove content and suspend accounts that violate these rules, at our discretion.

6. Listings, trades, and transactions

MyHobby is a cataloguing and community platform. Listings marked for sale, trade, or as wanted are informational. MyHobby does not process payments, take possession of items, act as escrow, or guarantee any transaction, and is not a party to any dealing between users.

Any transaction you enter into with another user is solely between you and that user. You are responsible for complying with applicable laws (including consumer-protection, tax, import/export, and sales laws) and for assessing the authenticity, condition, value, and legality of items. We strongly recommend exercising caution and meeting in safe, public settings for in-person exchanges.

7. Intellectual property

The Service, including its software, design, trademarks, and content we provide (excluding Your Content), is owned by MyHobby or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, or create derivative works of the Service except as permitted by law.

8. Third-party services and AI features

The Service relies on third parties, including hosting providers and an artificial-intelligence provider used to help identify collectible items from photos. AI-generated suggestions may be inaccurate; you are responsible for reviewing and correcting them. Your use of third-party features may be subject to those providers' terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI suggestions or user listings are accurate. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHOBBY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY USER-TO-USER TRANSACTION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (b) CAD $100. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold harmless MyHobby and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your transactions with other users, or your breach of these Terms, to the extent permitted by law.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (e.g., content licence for already-shared content, disclaimers, limitation of liability, indemnification, governing law) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws rules, and you submit to the courts located there, except where applicable consumer-protection law gives you the right to bring proceedings in your local jurisdiction. If you are a resident of the United States, mandatory consumer-protection laws of your state of residence may also apply.

Before filing a formal claim, you agree to first try to resolve the dispute informally by contacting us.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the version date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
